Solano County, California Arrest Records

A Solano County arrest record is a document indicating that a law enforcement agency has apprehended a person. It does not mean the person has been convicted of the crime for which they were arrested. It only contains basic identifying and procedural information. The Solano County Sheriff's Office (SCSO) and local police departments, including the Vallejo Police Department and the Vacaville Police Department, create arrest records and make them available to the public as required under the California Public Records Act (CPRA). 

Solano County residents should know that arrest records are separate from Criminal Offender Record Information (CORI), which is not public and is governed by 11 CCR § 703. CORI is more comprehensive than arrest records, covering the offender's arrest summary, pre-trial proceedings, disposition, sentencing, incarceration, rehabilitation, and release.

Are Arrest Records Public Information in Solano, California?

Yes. Arrest records are public under the California Public Records Act (CPRA). These records are open to inspection at all times during the office hours of Solano County law enforcement agencies, and everyone has a right to inspect and copy them (CA Govt Code § 7922.525). Every arrest record request must reasonably describe the desired record, and the record custodian must promptly make the records available to the requester upon payment of fees (CA Govt Code § 7922.530). The record custodian must respond to the request within 10 days of receipt (CA Govt Code § 7922.535).

What Do Public County Arrest Records Contain?

Solano County public arrest records contain the following information:

  • The inmate's full name (first, middle, and last) 
  • Imate number and projected release date 
  • Date of birth, eye and hair color, sex, height, and weight 
  • The name of the facility where the inmate is housed
  • Case number and name of arresting agency 
  • Arrest date, time, type, and location 
  • Booking number, date, time, and type 
  • Sentence code, bail amount, court location, 
  • Next court date and time 
  • Charge details, including severity, section, statute, and disposition 

This arrest information is being released to the public in accordance with the California Public Records Act. However, the arrested person's social security numbers will be closed to the public (CA Govt Code § 7922.200). Additionally, arrest information about a pending investigation, or that whose disclosure would endanger a person's safety, is deemed confidential. 

Solano County,  California Arrest Search

Members of the public may search Solano County arrest records through state and federal law enforcement agencies. The California Department of Corrections and Rehabilitation (CDCR) manages arrest records at the state level and disseminates them online and in person at its local facilities. The California Incarcerated Records and Information Search (CIRIS) online portal is the designated tool for searching arrest records of Solano County inmates housed in state prisons. The search criteria are by name or CDCR number. 

Individuals seeking federal arrest records must identify the record custodian and submit their request through the appropriate search methods. For example, the Federal Bureau of Investigation (FBI) issues arrest records to subjects of records online, by mail, or through approved channels for $18. Similarly, the United States Capitol Police (USCP) provides federal arrest records through the Weekly Crime Summary portal. Provide a crime date, CFN number, crime summary, or crime type to filter the search. The USCP also provides a Reports Request Form for mail requests. 

Solano County Inmate Locator

The Solano County inmate locator is available on the Sheriff's Office official website. Upon reaching the site, scroll to the "Quick Links" section and select "Jail - In Custody Search," which leads to the portal. Enter at least the first 3 letters of the first or last name of the inmate in the search box to find their arrest records. 

The Sheriff's Office also provides a Jail Booking Log that displays information about individuals arrested and booked into the Solano County Jail in the last 7 days. Users must provide a date range to perform a search.

Active Warrant Search in Solano County

Per CA Penal Code § 813, a Solano County magistrate will issue an arrest warrant when a complaint filed with them shows that an offense has been committed and there is reasonable ground to believe the defendant committed it. The warrant will specify the defendant's name or a designated name if the actual name is unknown (CA Penal Code § 815). It will also state the time it was issued, the city or county where it is issued, and carry the issuing authority's signature, the title of their office, and the issuing agency's name. 

The Solano County Sheriff's Office is the custodian of warrant information. However, the public may view warrant information online via the Superior Court's Case Search portal. Users must create an account and log in to the portal using an email and a password. Anyone seeking active warrants may call the Sheriff's Office Records and Warrants Bureau at (707) 421-7010 or visit the office during business hours to submit their inquiry.  

How to Find Arrest Records for Free in Solano County

The Solano County Sheriff's Office (SCSO) offers two free options to search arrest records. Both options are available online on their website. The first is the In Custody Web Search tool, which allows requesters to search for inmates currently housed in the Solano County Jail for free. Users must provide at least 3 letters of the inmate's first or last name to perform a search. The second option is the Jail Booking Log, which provides public data on persons arrested and booked into the jail within the last 7 days. A date range is required for this search.

The SCSO offers arrest data via these free portals for informational purposes only; it should not be relied upon for official purposes. These tools sometimes contain incomplete or inaccurate information, and the data for some inmates might not be in them. 

Solano County Arrest Report

The terms "arrest record" and "arrest reports" are often used interchangeably, but they are distinct legal documents in Solano County. Arrest records are documents that contain summary entries indicating that a person was arrested and are usually part of criminal history information under CA Penal Code § 11105. Conversely, arrest reports are detailed narrative documents that contain everything about an arrest, including events leading to the arrest, statements about suspects, witnesses, and victims, evidence collected, and probable cause. Arrest reports are part of law enforcement agencies' investigative files. Arrest records are always generated from arrest reports. While arrest records are considered public under the California Public Records Act (CPRA), the full arrest report is exempt from public disclosure. 

How to Get an Arrest Record Expunged in Solano County

An arrest record may make obtaining housing, finding a job, and enrollment in education and funding very difficult. However, the Solano County Public Defender's Office helps eligible individuals expunge their arrest records so that they may have a fresh start. Review the CA Pen. Code,  § § 1203.4,  1203.4a, 1203.49, 1203.41, 1203.42, and 1203.43 to determine eligibility. Here is how to begin the expungement process:

  • Get the necessary case information

To begin the expungement process, eligible individuals must obtain their case information from the Solano County Superior Court. Specifically, they need their case number, the conviction or arrest date, the code section of the conviction or arrest, and the county of conviction or arrest, all of which can be viewed through the Case Search portal. 

  • Obtain a hearing date

Applicants must request a hearing date from the Solano County Superior Court Criminal Division Clerk by phone at (707) 207-7380 (Fairfield Criminal Division) or (707) 561-7880 (Vallejo Criminal Division) or email at criminaldivision@solano.courts.ca.gov. The hearing date, time, and department should be included in the paperwork.

  • Complete and file the appropriate paperwork

Individuals whose arrest did not result in a conviction may have been granted automatic expungement by the California Department of Justice (DOJ) under CA Pen. Code,  §851.93. However, if this is not the case, the individual may file a Petition to Seal  Arrest and Related Records (CR-409) Form with the Solano County Superior Court Criminal Division. If the case resulted in a conviction, the petitioner must complete the Petition for Dismissal (CR-180) and the Order for Dismissal (CR-181) Forms. Submit three copies of CR-180 and two copies of CR-181 to the clerk's office by mail or place them in the dropbox (Monday through Friday from 8:00 a.m. to 5:00 p.m.) at any of the Solano County Superior Court branches. 

  • Serve the District Attorney's office

  • Go for the hearing 

At the hearing, the judge will either grant or deny the petition after determining the petitioner's eligibility. If the petition is granted, a copy of the expungement order will be sent to all relevant law enforcement agencies involved in the case. 

How Do You Remove Solano County Arrest Records From the Internet?

Eligible individuals may have their Solano County arrest records removed from the internet by submitting a Petition to Seal Arrest and Related Records (CR-409) Form to the Superior Court. Once the petition is granted, the court will send the expungement to every law enforcement agency involved in the case. The agencies will be required to update their databases to reduce the likelihood of finding expunged arrest records online. 

Individuals who want to remove their arrest records from third-party websites should start by submitting the appropriate opt-out form to those sites. If the site does not offer an opt-out, contact them to request removal of the data. To do this, the requester may submit a query via the site's contact form or check whether the site provides a phone number or email address. Lastly, interested persons may seek assistance from a legal practitioner if the third-party sites are not responding to their requests.
